Terms. By signing in to, accessing, or otherwise using the Vivid Faith website (this "Site"), you agree to this Terms and Conditions (“Terms”). If you disagree with any part of these Terms, do not use this Site. We reserve the right to change these Terms at any time, so please check for changes to these Terms each time you use this Site. Your continued use of this Site following the posting of changes to these Terms means that you accept those changes.

Licenses and Restrictions. This Site is owned and operated by the General Conference Corporation of Seventh-day Adventists and the General Conference of Seventh-day Adventists ("we", "us", or a similar term), located at 12501 Old Columbia Pike, Silver Spring, Maryland 20904, United States of America. You may view, download, and print material from this Site only for your personal, noncommercial use unless otherwise indicated. In addition, materials from this Site may be reproduced by media personnel for use in traditional public news forums unless otherwise indicated. You may not post material from this Site to another website or on a computer network without our permission. You may not transmit or distribute material from this Site to other websites. You may not use this Site or information found at this Site (including the names or addresses of those who have submitted information to this Site) to sell or promote products or services, to solicit clients, or for any other commercial purpose. We reserve sole discretion and right to deny, revoke, or limit use of this Site, including the reproduction and any other use of any material available through this Site. 

About VividFaith. VividFaith is a virtual community that connects people with service opportunities by matching a user’s profile with the needs of partner organizations. Service opportunities posted on VividFaith are received from organizations vetted and approved by the VividFaith Oversight Committee. While VividFaith matches users with opportunities, it is not involved in the approval process of applications, the deployment of users to volunteer locations, or in the supervision of users during the volunteering period. VividFaith also provides a social media platform for VividFaith users that allow them to post updates of their volunteer assignment and to communicate with one another. Additionally VividFaith offers educational and inspirational resources of its users.

VividFaith uses the following terminology that is unique to its virtual community: a) VividFriends are registered VividFaith users who are searching for volunteer opportunities, supporting someone who is volunteering, taking a course or learning a new skill by using VividFaith resources, or is an inactive user observing the activities of other agents. b) Assignments are volunteer opportunities. c) Service Providers are organizations with a Memorandum of Understanding with VividFaith that allow them to post their volunteer opportunities as Assignments on VividFaith.  c) Hosts are organizations within the geographical oversight of a Service Provider and the location where the Assignment takes place. d) Coordinators are representatives of Service Providers who function as liaisons between VividFriends and Hosts.

VividFaith matches VividFriends with available Assignments based on information provided by Service Providers, and shall not be held liable for changes to the Assignment details that occur after the match has been made. VividFaith shall make every effort to help the VividFriend with any question, query, or irregularity pertaining to the services. 

VividFriends are responsible for a) supplying all the documentation required when applying for an Assignment; b) controlling the privacy options of their profile that determine which portions of their profile are accessible by other VividFriends; c) being truthful and accurate when completing their profile and when applying for Assignments; d) responsible for all expenses related to an Assignment that are not explicitly stated as being included in each Assignment description.

Code of Conduct. You agree that you will not individually, or as part of any collective effort, submit or post information to this Site that could be deemed harmful or offensive to other users, nor will you impersonate another user in order to hide your identity or to implicate another in such actions. You further agree to do nothing that might disrupt the flow of data to and from this Site, impact the service or performance of this Site, or circumvent any of the controls or usage rules that we have implemented. You understand and agree that the result of harmful or offensive actions (or any other breach of these Terms of Use) may include revocation of your right to use this Site and its materials, and legal action against you.

Interactions with Others. This Site provides a platform for individuals to learn about and coordinate service opportunities. We are not a party to, have no involvement or interest in, make no representations or warranties as to, and have no responsibility or liability with respect to any communications, transactions, interactions, disputes, or any relations whatsoever between you and any other person or organization, whether or not you found or otherwise interacted with such person or organization through, or as a result of your use of, this Site.

We cannot and do not confirm the identity of any person using this Site. You are solely responsible for determining the identity and suitability of others with whom you may interact through, or as a result of using, this Site. We do not represent or warrant that this Site is sufficient to determine whether it is appropriate for you to interact with others. Further, we do not endorse any persons who use or register on this Site.

We do not investigate or verify any person’s reputation, conduct, morality, criminal background, or any information others may submit to this Site. In this regard, if, however, any person you encounter through this Site requests that you contribute money, you should notify us immediately, as this is contrary to our policy and the purpose of this Site.

User Content.  We reserve the right to refuse to accept, or to remove from this Site, any User Content for any reason, such as if we believe that it may subject us to legal liability or that it may violate these Terms.

You agree not to post User Content that: (i) may create a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to you, to any other person, or to any animal; (ii) may create a risk of any other loss or damage to any person or property; (iii) seeks to harm or exploit children by exposing them to inappropriate content, asking them for personally identifiable information, or otherwise; (iv) may constitute or contribute to a crime or tort; (v) contains any information or content that we deem to be unlawful, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, profane, or otherwise objectionable; (vi) contains any information or content that is illegal; (vii) contains any information or content that you do not have a right to make available under any law, including data protection law, or due to any contractual or fiduciary relationship; (viii) contains any information or content that you know or believe is not correct and current; or (ix) promotes, or otherwise incites, discrimination, racism, bigotry, hatred, or physical harm of any kind against any group or individual. You agree not to use this Site to do anything unlawful, misleading, malicious, or discriminatory, and you understand and agree that your failure to comply with this provision may lead to your loss of access to the Site.

You agree that any User Content that you post does not and will not violate any third party right of any kind, including, without limitation, any Intellectual Property Rights (as defined below). To the extent that your User Content contains third party content, you hereby represent that you are the owner of, or have a valid license to, all the Intellectual Property Rights of such third party content, and have the power to grant the license granted below. You hereby represent that you have the written consent of each and every identifiable natural person whose likeness appears in your User Content to use and allow us and this Site's users to use such person's name or likeness in the manner contemplated by this Site and by these Terms, and each such person has released you and us from any liability that may arise in relation to such use. You will supply us with these written consents if we request you to do so. We reserve (as stated above) the right, but not the obligation, to reject and/or remove any User Content that we believe, in our sole discretion, violates these provisions without admission or liability. For the purposes of these Terms, "Intellectual Property Rights" means any and all patent rights; copyright rights; moral rights; rights of publicity and rights of privacy; trademark, trade dress, and service mark rights; goodwill; trade secrets; and other intellectual property rights as may now exist or hereafter come into existence, and all applications therefor and registrations, renewals, and extensions thereof, under the laws of any state, country, territory, or other jurisdiction.

To the extent permitted by applicable laws, we assume no responsibility and we assume no liability for any User Content that you or any other user or third party posts on this Site. You shall be solely responsible for your User Content and the consequences of posting or publishing it, and you agree that we are only acting as a passive conduit for the online display of your (and others') User Content. You understand and agree that you may be exposed to User Content that is inaccurate, objectionable, inappropriate for children, or otherwise unsuited to your purpose, and you agree that we shall not be liable for any damages you allege to incur as a result of any such User Content.

User Content License Grant. By posting any User Content on this Site, including, without limitation, your or another’s name, likeness, logo, tradename, trademark, service mark, or copyrighted materials, you expressly grant to us, and you hereby represent and warrant that you have all rights necessary to grant to us, a royalty free, sublicensable, transferable, perpetual, irrevocable, nonexclusive, and worldwide license to use, reproduce, modify, publish, transmit, list information regarding, edit, translate, distribute, publicly perform, publicly display, and make derivative works of all such User Content, in whole or in part, and in any form, media, or technology, whether now known or hereafter developed, for use in connection with this Site.

No Control Over Third Parties. If you are using the services to find volunteer opportunities, your correspondence and/or ensuing relationship with other Service Providers or third parties found on or through the services including posting or acceptance of volunteer opportunities, and any other terms or conditions associated with such dealings, are solely between you and the third party you choose to deal with. 

YOU AGREE THAT WE WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS, COST, DAMAGE, OR OTHER LIABILITY OF ANY SORT INCURRED AS THE RESULT OF ANY SUCH DEALINGS, OR AS THE RESULT OF THE PRESENCE OF SUCH PARTIES ON THE SERVICES AND YOU HEREBY IRREVOCABLY WAIVE ANY CLAIMS AGAINST US ARISING FROM OR RELATED TO YOUR RELATIONSHIP WITH A THIRD PARTY.

Release. You hereby release us, our officers, employees, agents and successors from claims, demands any and all losses, damages, rights, claims, and actions of any kind including, without limitation, personal injuries, death, and property damage, that is either directly or indirectly related to or arises from (i) any interactions with other VividFaith users (including volunteer opportunities), or (ii) your participation in any volunteer activities or activities arising from or related to your use of the Services.

Intellectual Property. All information on this Website is copyrighted by the General Conference Corporation of Seventh-day Adventists®, a District of Columbia nonprofit corporation, or the General Conference of Seventh-day Adventists®, a Maryland unincorporated association (collectively, the "General Conference"). All rights are reserved. United States copyright law protects all materials contained on this site. By using this site, you acknowledge that the General Conference owns all intellectual property rights in and to the site and its contents and that these rights are valid and protected in all forms. You may not modify, remove, delete, augment, add to, exploit, publish, transmit, participate in the transfer or sale of, and/or create derivative works from the content either in whole or in part.  VividFaith is a trademark of the General Conference Corporation of Seventh-day Adventists. 

Linking. For your convenience, this Site may contain links to websites operated by others. Those third party websites are not maintained or controlled by us, and we are not responsible for their content. Although we have made a good-faith effort to link only to tasteful and appropriate websites, some may contain inappropriate or objectionable material. If you find such material while using a website that you accessed through a link on this Site, please notify us immediately.

We do not control, endorse, or adopt any third party content and shall have no responsibility for the same, including, without limitation, material that may be misleading, incomplete, erroneous, offensive, indecent, or otherwise objectionable. You must evaluate and bear all risks associated with third party content.

Limitations of Liability. To the extent permitted by applicable laws, we are not liable for any direct, special, or consequential damages, or any other damages of any kind, resulting from or arising out of your use of, or your inability to use, this Site or any linked website or the services provided or arranged through this Site, including, but not limited to, personal injury claims, lost wages, property damage, lost profits, business interruption, and loss of programs or other data on your information handling system.

Language. While the website is provided in a number of languages, the terms of use and any communications made by or to us shall be made in English.

Indemnity. You shall defend, indemnify, and hold harmless us (and each of our officers, directors, members, employees, agents, volunteers, and affiliates) from any claim, demand, action, damage, loss, cost, or expense, including, without limitation, reasonable attorneys' fees, arising out of or relating to your use of, or your participation in services provided or arranged through, this Site that violates these Terms. If you are obligated to indemnify us, we will have the right, in our sole and unfettered discretion, to control any action or proceeding and determine whether we wish to settle it, and if so, on what terms.

Disclaimers. YOU EXPRESSLY AGREE THAT USE OF THE SITE, APP, AND SERVICES IS AT YOUR SOLE RISK. THE SERVICES, APP, AND SITE ARE ALL PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Term. This Agreement shall remain in full force and effect while you use the Site, App, and/or Services, or are a VividFaith agent. You may terminate your VividFaith membership at any time, for any reason, by sending an email to  [email protected] We may terminate or suspend your membership for any reason in our sole discretion, effective immediately upon sending notice to you at the primary e-mail address you have stored in your VividFaith profile.

Jurisdiction and Applicable Law. The Terms constitute the entire and exclusive and final statement of the agreement between you and us with respect to the subject matter hereof, and govern your use of the services, superseding any prior agreements or negotiations between you and us with respect to the subject matter hereof.   
This site is created and controlled under the laws of the State of Maryland, which shall be the law giving effect to and interpretation of all terms and conditions hereunder.  Any action pertaining to this website shall be in the State of Maryland with Montgomery County the venue for such action.  Any person named a party to any action regarding this Web site agrees to submit to the exclusive jurisdiction of the courts of the State of Maryland and of the United States of America located in the State of Maryland.

Privacy. The collection, use, and disclosure of your personal information is described in our Privacy Notice available at  privacy.adventist.org

Survival. Any limitations on liability explicitly set forth herein shall survive the expiration or earlier termination of the Terms for any reason. Our (and our licensors') proprietary rights (including any and all Intellectual Property Rights) in and to Our Content and the Services shall survive the expiration or earlier termination of the Terms for any reason.
